Veterans Disability Benefits in New Mexico

The VA uses a rating system to gauge the severity of the disabilities. Each disability is assigned a percentage ranging from 10% to 100%, with higher percentages indicating a more serious condition and thus a larger monthly payment.
Veterans are typically required to undergo a Compensation & Pension (C&P) exam. Conducted by the VA, this medical assessment helps determine the severity of a veteran's service-related disability.
If a veteran has multiple disabilities, each is evaluated separately. These individual ratings are then consolidated to provide a total overall disability rating.
Eligibility Requirements for VA Disability Benefits
To qualify for VA benefits, New Mexico veterans must meet several guidelines.
Both of these must be true:
- You have an existing condition, either physical or mental, that impacts your health, and
- Your service history includes active duty, active duty for training, or inactive duty training.
And, at least one of the following must be true:
- You incurred an injury or sickness during your military service that can be connected to your current condition. This is known as an in-service disability claim.

- An existing injury or illness from before your military service worsened due to your service — called a pre-service disability claim, or
- You have a disability that is associated with your active-duty service but it only manifested after your service ended. This is known as a post-service disability claim.
For a successful VA disability claim, having strong medical evidence is key. Your medical evidence should be able to prove your health complications are a result of your military service.
Well-documented medical records help paint a clear picture of how your condition developed or worsened during your service. The stronger and more detailed this evidence, the better your chances of getting the benefits you rightly deserve.
How to Apply for VA Disability in New Mexico
Gather your documents and medical evidence before you apply for disability benefits. Include your military records, doctor statements, and your DD214 form or other confirmation of your military separation.

Once you've gathered all your necessary paperwork, you're ready to apply. The easiest way to submit a claim is online at VA.gov. Click on "Sign in to start your application" and follow the on-screen instructions.
If you don't have internet access, you can mail your application or drop it off yourself at the nearest VA office.

Processing times at the VA can vary, typically taking between 3-6 months or possibly longer. To expedite the process, be sure to provide complete and accurate information in your claim.
Appeal a Denial
If you're a New Mexico veteran and your VA disability claim is denied, you have the right to file an appeal and protest the decision. Start your appeal by submitting a Notice of Disagreement form within a year from when you received the denial notice.
